These Terms of Service constitute a legally binding agreement between you and CoachCards. By accessing or using this platform in any capacity, you confirm that you have read, understood, and agreed to be bound by these terms.

By accessing or using the Platform in any capacity — including browsing as a visitor, registering as a Trainer, or submitting a Review as a Client — you agree to be legally bound by these Terms of Service and our Privacy Policy.

If you do not agree to these Terms in their entirety, you must immediately cease all use of the Platform. Trainers who register an account provide additional express consent by completing the sign-up process, which constitutes a binding agreement between the Trainer and CoachCards.

⚠️ You must be at least 18 years of age to register as a Trainer or submit a Review. By using the Platform, you confirm that you meet this requirement.

3. Our Services

CoachCards provides a public directory and ranking platform for personal trainers in the United Kingdom. Our services include:

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time with reasonable notice where practicable. The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, that the Platform will be uninterrupted or error-free.

4. Trainer Obligations

4.1 Accuracy of Information

You warrant that all information on your profile — including name, qualifications, certifications, location, and biography — is accurate, complete, and not misleading. You agree to keep this information current. Providing false or misleading information is grounds for immediate account termination.

4.2 Qualification Compliance

You confirm that you hold all qualifications, registrations, and insurance policies required by law and applicable industry bodies (including but not limited to REPs, CIMSPA, or equivalent) to operate as a personal trainer in the UK. CoachCards does not verify qualifications and bears no liability for misrepresentation by Trainers.

4.3 Review Link Usage

Review Links must only be shared with genuine clients who have undertaken a bona fide training session with you. You must not solicit Reviews from friends, family, or any person who has not received your personal training services, nor offer incentives of any kind in exchange for Reviews. Breach of this clause may constitute fraud and will result in immediate account termination and potential referral to the relevant authorities.

Submitting a false, misleading, or malicious Review may constitute defamation under English law. CoachCards reserves the right to remove any Review it reasonably believes breaches these obligations and to report fraudulent activity to the relevant authorities.

6. Reviews Policy

6.1 Publication

Reviews submitted via the Platform are published publicly on the relevant Trainer's profile. By submitting a Review, you grant CoachCards a perpetual, royalty-free, non-exclusive licence to display, reproduce, and use your Review content on the Platform.

6.2 Trainer Rights Regarding Reviews

Trainers cannot edit, delete, or suppress Reviews. This protects the integrity of the ranking system and client trust. CoachCards will not remove a Review at a Trainer's request unless it is determined to be fraudulent, defamatory, or otherwise in breach of these Terms following a formal investigation.

6.3 Review Disputes

If a Trainer believes a Review is fraudulent or defamatory, they may raise a formal dispute by emailing personaltrating@protonmail.com with supporting evidence. We will investigate within 14 working days and notify all parties of our decision. Our decision is final.

6.4 Client Review Removal

A Client may request removal of their own Review at any time by contacting us. We will remove it within 7 working days of a verified request.

6.5 BMP Score

The BMP Score is a proprietary metric calculated solely by CoachCards. We reserve the right to adjust the algorithm at any time. Trainers have no contractual entitlement to any specific BMP Score or ranking position.

7. Intellectual Property

All intellectual property rights in the Platform — including the BMP™ scoring algorithm, design, branding, software, database structure, and ranking methodology — are owned exclusively by CoachCards™ or its licensors. Nothing in these Terms transfers any intellectual property rights to any User.

The name CoachCards™, the BMP™ (Body Muscle Percentage) scoring system, and the overall concept of merit-based personal trainer ranking are proprietary to CoachCards™. Unauthorised reproduction, imitation, or adaptation of this platform — in whole or in part — is strictly prohibited and may constitute passing off or trade mark infringement under UK law.

Trainers and Clients retain ownership of Content they submit but grant CoachCards™ a worldwide, royalty-free licence to use such Content for the operation and promotion of the Platform. You must not reproduce, distribute, modify, or create derivative works from any part of the Platform without our express written consent.

Any attempt to replicate the Platform's design, scoring methodology, or brand identity — whether commercially or otherwise — will be pursued to the fullest extent permitted by law.

8. Limitation of Liability

8.1 No Warranty on Rankings

CoachCards makes no representation or warranty that BMP Scores or rankings accurately reflect the quality of any Trainer's services. Clients should conduct their own due diligence before engaging any Trainer.

8.2 Trainer–Client Relationships

CoachCards is a directory and ranking platform only. We are not a party to any agreement between a Trainer and a Client and accept no liability for any loss, injury, damage, or dispute arising from any such relationship.

8.3 Cap on Liability

To the fullest extent permitted by law, CoachCards's total aggregate liability to any User shall not exceed £100 (one hundred pounds sterling). We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profit, revenue, data, or business opportunity.

9. Termination

CoachCards reserves the right to suspend or permanently terminate any Trainer account, with or without notice, where we reasonably believe the Trainer has breached these Terms, engaged in fraudulent activity, or caused harm to any User or to the reputation of the Platform.

Trainers may request account deletion at any time by contacting us. Upon deletion, the Trainer's public profile will be removed within 30 days. Reviews may be retained in anonymised form for integrity and fraud prevention purposes. Termination does not affect any accrued rights or liabilities.

10. Governing Law & Dispute Resolution

These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes), shall be governed by and construed in accordance with the laws of England and Wales. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction.

Before commencing legal proceedings, we encourage Users to contact us directly to attempt informal resolution. We will use reasonable efforts to resolve disputes within 30 days of notification.

11. Changes to These Terms

We reserve the right to update or amend these Terms at any time. When we make material changes, we will update the effective date above and, where reasonably practicable, notify registered Trainers by email at least 14 days before the changes take effect. Continued use of the Platform after that date constitutes acceptance.
